Koua Fong Lee formally filed a motion Monday to intervene in a lawsuit against Toyota.
Lee was recently released from prison after spending more than two years in custody after his Toyota crashed into another car, killing three people in 2006.
He was convicted after the crash and sentenced to eight years in prison, but the case received a new look after Toyota's acceleration problems in some models. Lee's 1996 Camry was not part of the recall, however, a judge decided Lee deserved a new trial. Prosecutors said they wouldn't retry Lee and he was released.
Lee's attorneys formally filed a request to join an existing federal lawsuit filed by the victims' family.
A hearing is tentatively set for November 8.
